1. About these terms

This website, including all its pages, content and features (the "Site"), is owned and operated by Adskom India Private Limited, a company incorporated under the Companies Act, 2013, with CIN U74999DL2016FTC303819 and its registered office at 216, SSG Majesty Mall, Road No. 43, Guru Harikishan Marg, Pitampura, New Delhi 110034, India ("Adskom", "PlatFARM", "we", "us" or "our"). PlatFARM™ is a brand of Adskom.

These Terms of Use ("Terms") govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy policy. If you do not agree, please do not use the Site.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require a physical or digital signature.

2. Who may use the Site

The Site is intended for businesses, agencies and professionals seeking information about PlatFARM's services. By using it, you confirm that you are at least 18 years old and legally able to enter into a binding contract under Indian law. If you use the Site on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation.

3. Information on the Site

The Site describes PlatFARM's services in general terms for information only. Audience sizes, profiles, examples, maps, case illustrations and other figures are indicative, may be based on samples or estimates, and may change without notice. Nothing on the Site is an offer, a guarantee of results or professional advice. Any services we provide are governed solely by a separate written agreement between you and Adskom.

Images on the Site are illustrative. Some are licensed stock photographs or digitally created images and do not depict actual PlatFARM users or customers.

4. Intellectual property

The Site and its content, including the PlatFARM name and logo, text, graphics, illustrations, designs, layouts, data visualisations and software, are owned by or licensed to Adskom and are protected by Indian and international intellectual property laws. PlatFARM™ and related marks are trademarks of Adskom. Other names and marks shown on the Site belong to their respective owners.

You may view the Site and print or download extracts for your own internal, non-commercial reference, provided you do not modify them and you keep all copyright and trademark notices. Any other use, including copying, reproducing, republishing, framing, distributing or creating derivative works, requires our prior written consent.

5. Acceptable use

You agree not to:

• use the Site in any way that breaks any applicable law or regulation;
• attempt to gain unauthorised access to the Site, our servers or any connected systems or data;
• introduce viruses, malware or any other harmful code, or interfere with the Site's operation or security;
• scrape, crawl, harvest or extract data or content from the Site by automated means without our written permission;
• reverse engineer any part of the Site, except as permitted by law;
• impersonate any person or organisation, or misrepresent your affiliation with anyone;
• submit information that is false, misleading, defamatory or that infringes anyone else's rights; or
• use the Site or its content to build a competing product or service.

6. Enquiries and information you send us

When you contact us through the Site or by email, you confirm that the information you provide is accurate and that you are entitled to share it. We handle personal data in line with our Privacy policy and the Digital Personal Data Protection Act, 2023. Unless agreed otherwise in writing, any ideas, feedback or suggestions you send us are not confidential, and we may use them without obligation to you.

7. Third-party links and services

The Site may link to or use third-party websites and services, such as font, hosting or analytics providers. We do not control and are not responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their own terms.

8. Availability and changes

We may update, change, suspend or withdraw any part of the Site at any time without notice. We do not guarantee that the Site will always be available, uninterrupted, secure or free from errors.

9. Disclaimer

To the fullest extent permitted by law, the Site and its content are provided on an "as is" and "as available" basis, without any warranty of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose or non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Adskom, its directors, employees and partners will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, data or goodwill, arising from or in connection with your use of, or inability to use, the Site or any content on it, even if advised of the possibility of such loss.

Our total aggregate liability arising from or in connection with your use of the Site will not exceed INR 10,000. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Adskom, its directors, employees and partners from any claims, losses, liabilities, costs and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

12. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Site after any change means you accept the revised Terms.

13. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the clause below, the courts at New Delhi, Delhi shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.

Before starting any legal proceedings, both parties will first try in good faith to resolve the dispute through discussion within 30 days of written notice.

14. General

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue in full force. Our failure to enforce any right does not waive that right. These Terms, together with our Privacy policy, form the entire agreement between you and us about your use of the Site. You may not transfer your rights under these Terms. We may transfer ours to an affiliate or successor.

15. Grievance officer and contact

In accordance with the Information Technology Act, 2000 and the rules made under it, you may contact our Grievance Officer with any complaint about the Site or its content. We will acknowledge complaints within 24 hours and aim to resolve them within 15 days.
